Are you a Tax Practitioner or do you intending to register as one in terms of current legislation governing persons who practice or wish to practice as such?

According to the Tax Administration Act (Act 28 of 2011) which came into effect on 1 October 2011, you should register as a tax practitioner if you provide tax advice or assist taxpayers with preparation of their annual tax returns for a fee.

From 1 July 2013, says SARS, even if you are currently registered as a tax practitioner, you should also register for membership ah one of the controlling bodies, such as the South African Institute of Tax Professionals (SAIT) on or before 1 July 2013 or within 30 days after commencing to provide tax advice or assistance with tax preparation.

The South African Revenue Service also announced the following warning: Failing to adhere to the rules and regulations as stated in the Tax Administration Act is a serious offense. Offenders could spend up to two years imprisonment if found out.

To register your tax practice for membership of a controlling body, register with the South African Institute of Tax Professionals.
